CANCELLATION
POLICY.
Free
cancellation 48hrs prior to rental time.
A
cancellation fee of 30% will be charged after this time, except in
the event of rain.
GENERAL
RENTAL CONDITIONS
FOR
GROUP RENTALS (6 BIKES OR MORE), A DEPOSIT OF 30% OF THE TOTAL
INVOICE AMOUNT WILL BE REQUIRED UPON RESERVATION.

NOTE THAT A $20 FEE MAY APPLY IF THE BIKE IS NOT RETURNED ON TIME.
1-
Emobilitecafe (THE LESSOR) rents to the customer (THE RENTER), whose
signature appears below, the equipment designated above. This rental
is subject to these conditions which THE RENTER accepts and agree to
comply with.
2-
THE RENTER declares that he/she holds a civil liability insurance
policy.
3-
THE RENTER declares that he/she is fit to drive the rented cycle and
has no medical contraindications.
4-
The rental contract is neither transferable nor assignable. Lending
or subletting the equipment supplied by THE LESSOR is strictly
forbidden.
5-
The rental takes effect when THE RENTER takes possession of the
bicycle and accessories provided. The RENTER assumes full
responsibility for its safekeeping.
6-
This contract is valid only for the rental period specified in the
special conditions on page one.
Any extension of the contract will be subject to the LESSOR's
agreement.
7-
THE RENTER acknowledges having received the rented bike in good
working order with basic equipment. He/she declares that he/she
personally had all the leeway
to check the equipment and choose it according to his/her needs.
8-
THE RENTER undertakes to use the rented bicycle with caution, without
danger to third parties and in accordance with current regulations.
THE RENTER is personally liable for any breach of the traffic
regulations and is always responsible for any injury or
damage to property he/she
may cause to himself/herself
or to others while using the rented equipment. The LESSOR is
expressly exempt from liability in the event of failure to comply
with legal requirements, refusal to wear protective equipment
(helmet) or injury resulting from handling
the equipment.
9-
THE RENTER agrees to use the equipment as is. It is THE RENTER's
responsibility to check the equipment before leaving. THE RENTER
undertakes to return the equipment in the same condition as when
he/she left.
10- THE RENTER
is personally liable for any damage, theft or breakage. However, THE
RENTER shall not
be held liable for the harmful consequences of any hidden defects in
the leased equipment or unapparent wear and tear that renders it
unfit for the use for which it was intended, insofar as proof of said
defects or wear and tear can be provided by THE RENTER.
11-
Damaged parts or components will be repaired or replaced at the
LESSOR's discretion. THE RENTER agrees to pay normal shop rates and
retail prices for any equipment replaced. Normal wear and tear does
not include broken spokes, bent rims, frames, handlebars, seats or
any other damaged parts resulting from misuse of equipment or
accident.THE RENTER accepts that his credit card will be debited by
THE LESSOR for any fees incurred in the event of damage, loss or
theft.
12-
Repairs, maintenance and exchanges of parts or tires resulting from
normal wear and tear are the LESSOR's responsibility. Repairs made
without the LESSOR's agreement will not be reimbursed. The RENTER is
strictly forbidden to modify the rented equipment.
13-
THE RENTER undertakes to keep the equipment attached to a fixed
attachment point by a lock (supplied) outside periods of use, and to
keep the keys to the lock.
14-
In the event of theft
of the rented equipment, THE RENTER shall immediately notify THE
LESSOR at 819-640-8780
and lodge a complaint with the appropriate authorities, and provide
THE LESSOR with the police report.
THE
LESSEE undertakes to reimburse THE LESSOR for the original price of
the equipment, including all accessories supplied at the time of
rental.
15-
In the event of any breakdown
or incident
whatsoever, THE RENTER may contact the E Mobilité Café staff at
819-640-8780.
16-
THEFT AND LOSS of equipment are not covered. In such cases, the
equipment will be invoiced to the RENTER on the basis of its value.
In the event of theft by THE RENTER, misappropriation or damage of
any kind resulting from non-compliance with the rules of use or
regulations in force, or with the terms and conditions of this
contract, THE LESSOR shall be entitled to recourse for the full
amount of the loss suffered.
17-
When the equipment is made available by THE LESSOR, the RENTER is
required to pay a deposit of $300 per bike,
which will be returned to THE RENTER, less any damage as provided for
above. Under no circumstances may the deposit be used to cover an
extension of the rental period.
18-
THE RENTER is obliged to return the rented equipment to the point of
departure. The equipment must be returned at the time stipulated in
the contract. Additional charges may apply if the equipment is not
returned at the agreed time.
19-
In the event of any dispute relating to the present contract, the
competent court will be that of the LESSOR's head office.
