Terms and Conditions
Welcome to Local Motion’s bike rental website (“Site”). Please review the following basic rules (“Terms," “Terms and Conditions”) that govern use of our Site and your rental of, and use of, our equipment (“Service” or “Equipment”) through our Site as they constitute a legally binding agreement between you and Local Motion. Please note that your use of our Site constitutes your acceptance of these Terms and your agreement to be bound by them.
You expressly agree that your use of this Site and this Service is at your sole risk. The service delivered to you is provided “as is” and “as available” for your use, without warranties of any kind, either express or implied.
Placing your reservation
You acknowledge that all Services purchased under these Terms are intended for personal non-commercial use only and will not be re-sold. You acknowledge that you are at least 18 years of age. You acknowledge that when placing your reservation for multiple items, all persons involved in the reservation will be bound by these Terms. From time to time we may restrict the quantity of Services which can be purchased in one reservation during a particular period of time or per person or address. Any quantity restriction will be stated on the product page or in materials about the relevant service.
Payment methods
Payment methods are specified on the Site or explained by the Staff member at the time you place your reservation. Payment methods include major credit cards. Gift certificates issued by Local Motion will be credited as a discount to the final cost. Payment must be received at the time of reservation. If your payment cannot be processed, your reservation will be rejected and you will be notified of this on the Site. If a credit card cannot be processed, you should contact your card issuer to resolve the problem, or use an alternative payment method in order to continue with your reservation.
Reservation cancellation
Unless provided for under these Terms or as otherwise agreed by us, cancellations may only be made no less than 24 hours before the pick-up time of reservation for a full refund. Cancellations made within 24 hours of the time of pick-up of reservation will result in a charge of 100% of the rental charge.
Late fee
A late fee of $25 per bike will be charged if you return the bike outside of the rental time. Your tardiness affects other reservations that we would be forced to alter.
Limitation of liability
You expressly agree that use of this Site and participation in any activities described herein are at your sole risk. You expressly agree that neither Local Motion, nor any of its employees, officers, directors, agents, employees, contractors, volunteers and any other persons or entities acting on its behalf, and the successors and assigns for any and all of the aforementioned persons and entities (collectively, the “Indemnified Parties”), is responsible or liable to any person or entity whatsoever for any loss, damage (whether actual, consequential, punitive or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based upon or resulting from the use or attempted use of this web site or any other linked site. By way of example, and without limiting the generality of the foregoing, Local Motion and related persons shall not be responsible or liable for any claim or damage arising from failure of performance, error, omission, interruption, deletion, defect, delay in operation, computer virus, theft, destruction, unauthorized access to or alteration of personal records, or the reliance upon or use of data, information, opinions or other materials appearing on this Site. You expressly acknowledge and agree that Local Motion is not liable or responsible for any defamatory, offensive or illegal conduct of other subscribers or third parties.
Release, Waiver of Liability and Assumption of Risk
You expressly agree that, by your use of our Equipment (“Activity”), you hereby release and discharge, indemnify, hold harmless and agree to defend Local Motion Inc. and its officers, directors, agents, employees, contractors, volunteers and any other persons or entities acting on its behalf, and the successors and assigns for any and all of the aforementioned persons and entities (collectively, the “Indemnified Parties”), against any and all claims, demands, and causes of action whatsoever, whether presently known or unknown, either in law or in equity, relating to injury, disability, death or other harm, to person or property or both, arising from my participation in or presence at the Activities, whether caused by the negligence of Local Motion, the Indemnified Parties, or otherwise, to the fullest extent allowed by law.
You are aware of the hazards and risks which may be associated with my participation in the Activity, including the risks of bodily injury, death or damage to property which may occur from known or unknown causes. You understand, accept, and assume all such hazards and risks, and waive all claims against Local Motion and the Indemnified Parties. You understand that you are solely responsible for any costs arising out of any bodily injury or property damage sustained through your participation in normal or unusual acts associated with the Activity. Local Motion has offered you a helmet during the use of the Equipment. You acknowledge that you have been instructed in and have become familiar with the proper operation of brakes, shifting and quick release mechanisms on the Equipment and agree to abide by all rules and instructions governing the Activity. However, you are not relying on Local Motion to supervise or control your participation in the Activity or to warn you of every possible danger associated with it.
You agree that you are responsible for all damage or loss (other than ordinary wear and tear) to the Equipment and that you will be charged full retail value for such damage or loss occurring during your use. You acknowledge that you will be charged at full retail value of the equipment if it is not returned within 48 hours of the agreed upon return date and time. Upon the return of the listed Equipment you will be credited for the purchase price of the Equipment minus additional rental charges for late returns and damage.
Use of personal information
We respect your privacy. We may collect and use your information for our mailing list. We may also be in touch with you to complete surveys relevant to our industry. To discontinue or unsubscribe from our mailing list, send an email to info@localmotion.org. Your personal information will never be sold or given to a third party.
Changes
