By continuing the check out process for your bicycle rental session, you hereby acknowledge that you have read, and agree to, the following liability waver:

You acknowledge and agree that cycling is conducted on public roads and all riding is a recreational activity which inherently involves a significant degree of physical exertion, physical risk and danger.

You understand that all applicable traffic laws must be followed and that you are solely responsible for your personal safety.

You acknowledge and agree that you are knowledgeable in the safe and proper operation of the rental bicycle which is associated with your bicycle rental session.

You acknowledge that you will be personally responsible for any fees or costs incurred or arising from an accident either involving or caused by you.

You acknowledge that this is a risk warning as applicable under Washington State law.

We recommend that you have health insurance suitable for cycling. You acknowledge and agree that you have been advised that you should have your own health insurance in place before renting a bicycle from Herriott Sports Performance LLC dba Métier Racing & Coffee.

To the greatest extent permitted by law, Herriott Sports Performance LLC dba Métier Racing & Coffee and its Representatives hereby exclude any liability (including in relation to any warranty or guarantee) for any loss, damage or liability to you or your personal possessions arising from your bicycle rental, including in respect of any death, physical or mental injury, or any aggravation, acceleration or recurrence of any condition. 

You agree to indemnify and hold harmless Herriott Sports Performance LLC dba Métier Racing & Coffee and its Representatives from and against any claims, liabilities, losses, damages, proceedings or actions including reasonable attorneys' fees and any settlements or ex gratia payments arising from your conduct during your rental session.

You agree and acknowledge you are liable for any physical damage to the rental bicycle associated with your bicycle rental period, including but not limited to scratches, cracks, dents, and deformation to any components on the bicycle. If the rental bicycle associated with your rental session is damaged, you will be charged the cost to repair the damage, the extent of which will be determined by our service department.
