Village Sport Shop waiver release

I accept for use, as is, the equipment listed on this form and accept full responsibility for its care while it is in my possession. I agree to hold harmless and indemnify Village Sport Shop for all loss or damage I may have cause to this equipment, except for reasonable wear and tear to the equipment.

I agree to hold harmless and indemnify Village Sport Shop and its owners, agents, and employees, as well as the equipment manufacturers and distributers, for any and all loss or damage I may cause to person or property while engaged in bike, ski or snowshoe related activities. This includes, but is not limited to, any and all claims for personal injury, death and/or property damage that may arise out of the use of this bike, skis or snowshoes, its equipment, or any equipment, regardless of whether such loss or damage be caused to myself or others.

I hereby release Village Sport Shop and all its owners, agents and employees, from any and all liability for damage and personal injury to me or my property resulting from Village Sport Shop's own acts of negligence. I understand that Village Sport Shop and its owners, agents and employees, are not responsible for the consequences of their own negligence, that is, their failure to use reasonable care in the operation of this bike, ski or snowshoes. I acknowledge that I am freely and expressly assuming and accepting and all risks or property damage, personal injury or death as the user of this equipment.

I understand am aware that biking, skiing and snowshoeing  is a HAZARDOUS ACTIVITY. I understand that biking, skiing or snowshoeing involves a risk of injury to any and all parts of my body. I hereby freely and expressly assume and accept responsibility for any and all risks of injury or death while participating in this activity.

I understand that it is not possible to predict every situation and condition of the terrain the bike, skis or snowshoes will be used on; therefore impossible to guarantee the bike, skis or snowshoes I use will react safely in all use conditions.

I realize that it is mandatory that I wear a helmet at all times while biking and that I obey all trail signs and remain only on open trails. If I am observed not wearing my helmet my Kingdom Trails issued trail pass may be revoked without reimbursement and I may not be able to use my rented equipment.

I have read the above paragraphs and fully understand them. I have made no misrepresentation to Village Sport Shop regarding my name, address, age, height or weight.

I understand that I am responsible for the safe keeping of this rental during the entire duration of my rental. If the bike/skis/snowshoes is lost, stolen or damaged, I am responsible for immediately paying Village Sport Shop for the retail value of the equipment or repair of the damage to the satisfaction of Village Sport Shop. Such payment, if possible, will be made and directed at the discretion of Village Sport Shop using the credit card on file and I consent to Village Sport Shop directing and accepting this payment.

This agreement is governed by the applicable law of Vermont. If any part of this agreement is determined to be unenforceable, all other parts shall be given full force and effect. I agree that there have been no warranties, expressed or implied, which have been  made to me which extend beyond the descriptions of the equipment I am renting. I, the undersigned, acknowledge that I have carefully read this agreement and release of liability and I understand its contents. I understand that my signature below expressly waives any rights I may have to sue Village Sport Shop for injuries and damages.

By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in wiring that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
