Tulum Rental Co. Electronic Equipment Rental Agreement  

1. Agreement Acceptance. 

1.1 By completing the payment process for renting equipment from Tulum Rental Co. ("THE COMPANY"), you, the customer ("THE RENTER"), agree to enter into this Equipment Rental Agreement ("AGREEMENT") electronically. The terms of this AGREEMENT are effective as of the transaction date and apply for the duration of the rental period purchased. 

2. Rental Equipment and Period.  

2.1 THE RENTER agrees to rent the selected equipment ("EQUIPMENT") for the period specified in the rental transaction. The rental period commences on the transaction date and lasts for the duration purchased by THE RENTER. 

3. Acknowledgment of Risks and Release of Liability.

3.1 THE RENTER acknowledges that the use of the EQUIPMENT involves inherent risks and  dangers, including the risk of physical injury, death, or other harmful consequences,  however, THE COMPANY shall not be held responsible for any harm that happens to him/her derived from the improper use of the equipment or that is derived from the paths, roads or choices that THE RENTER decides to take or make during the rental time.  

3.2 THE RENTER assumes all risks associated with the use of the EQUIPMENT and releases THE COMPANY, its agents, employees, and affiliates from any civil, criminal, or any other liability for injury, death, or damages arising from the use of the EQUIPMENT. 

4. Responsibility for Damages. 

4.1 THE RENTER is obligated to return the EQUIPMENT in the same state it was given, except for the normal wear and tear that implies the use of it.  

4.2 THE RENTER is obligated to use the EQUIPMENT only for its intended purposes and to not act in any way that puts his/her life or others in danger, being his/her responsibility to properly maintain the integrity of the EQUIPMENT for the rental term, using it accordingly to the applicable laws of the region.

4.3 THE RENTER also agrees to not modify, customize, or alter the state of the EQUIPMENT in any way that affects its value or its future use, or that could endanger the next person who uses it.  

4.4 If the EQUIPMENT is damaged in a way that is attributable to THE RENTER, be it by  negligence, improper or unlawful use of it, or any other way that implies their responsibility, THE RENTER shall pay THE COMPANY the necessary monetary compensation to repair said equipment. THE COMPANY is obligated to provide an appraisal with the estimated cost of repairs to THE RENTER within the next 10 working days of the delivery date and notification of damages. 

4.5 If the EQUIPMENT is left completely unusable for the same reasons as mentioned before, THE RENTER shall pay THE COMPANY the full purchase price of the EQUIPMENT. THE COMPANY shall provide proof of the EQUIPMENT’S worth within the next 10 working days after the damages were notified to THE RENTER.  

4.6 In both cases mentioned above, THE RENTER agrees that the payment will be charged to the credit card provided to THE COMPANY according to clause 7.1 of this AGREEMENT.  

5. Late Return Fees.

5.1 THE RENTER must give advance notice to THE COMPANY of a late return of the EQUIPMENT to the number +52 322 175 7183 and/or by email info@tulumrentalco.com, being subject to approval and denial. 

5.2 In case THE COMPANY allows the late return of the EQUIPMENT, this extension of time will be in half day increments after the agreed hour of return, for which THE RENTER will be charged a half day of rental per increment. 

5.3 In case that THE COMPANY doesn’t approve the late return and/or THE RENTER doesn’t return the EQUIPMENT at or prior to the agreed time, THE COMPANY will be allowed to charge a full day of rental for up to two days. 

5.4 If THE RENTER, without the written authorization of THE COMPANY, doesn’t return the  equipment after two days of the agreed return date, THE COMPANY will assume that the  equipment has been stolen or lost and will be allowed to charge the full purchase price of the EQUIPMENT to THE RENTER. 

5.5 For all the cases mentioned above, THE RENTER agrees that the payment will be charged to the credit card provided to THE COMPANY according to clause 7.1 of this AGREEMENT.    

6. Third-Party Use. 

6.1 THE RENTER agrees that the EQUIPMENT assigned is only to be used by the person who signed this AGREEMENT, being obligated to respond for any damages caused to it by any third party that uses it with or without his authorization.  

7. Payment Authorization and Card on File. 

7.1 THE RENTER authorizes a nominal charge of 0.01 MXN to their credit card to keep the card on file for incidentals or fees incurred if the terms of this AGREEMENT are violated. THE RENTER agrees that THE COMPANY may charge the card for any damages to the EQUIPMENT as described above.  

7.2 Once the equipment is delivered correctly and THE COMPANY determines that there are no damages to the EQUIPMENT attributable to THE RENTER, the credit card information shall be deleted from THE COMPANY’S records, being responsible for its safekeeping during the time of the rental under the “Ley Federal De Protección De Datos Personales En Posesión De Los Particulares.” 

8. Personal Information of the Renter.  

8.1 THE COMPANY has the implicit obligation to safeguard the information provided by THE RENTER, using it only for the purposes agreed upon by the parties, and shall be held  responsible for any damages that THE RENTER perceives from any leak of information or  misuse of it.  

9. Governing Law. 

9.1 This AGREEMENT is governed by the laws of the jurisdiction in which THE COMPANY operates.   

10. Electronic Consent.  

10.1 By completing the payment for the rental, THE RENTER electronically agrees to the terms and conditions of this AGREEMENT, including any terms displayed at the point of sale, which are subject to change.
