I accept for use, as is, the equipment listed on this form and accept full responsibility for its care while it is in my possession. I agree to hold harmless and indemnify East Burke Sports for all loss or damage I may have caused to this equipment, except for reasonable wear and tear to the equipment.

I agree to hold harmless and indemnify East Burke Sports and its owners, agents, and employees, as well as the equipment manufacturers and distributers, for any and all loss or damage I may cause to person or property while engaged in mountain bike related activities. This includes, but is not limited to, any and all claims for personal injury, death and/or property damage that may arise out of the use of this Mountain Bike Center, its equipment, or any equipment, regardless of whether such loss or damage be caused to myself or to others.

I hereby release East Burke Sports and all its owners, agents and employees, from any and all liability for damage and personal injury to me or my property resulting from East Burke Sports’ own acts of negligence. I understand that East Burke Sports and its owners, agents and employees, are not responsible for the consequences of their own negligence, that is, their failure to use reasonable care in the operation of this Mountain Bike Center. I acknowledge that I am freely and expressly assuming and accepting any and all risks of property damage, personal injury or death as the user of this equipment.

I understand and am aware that mountain biking is a HAZARDOUS ACTIVITY. I understand that mountain biking involves a risk of injury to any and all parts of my body. I hereby freely and expressly assume and accept responsibility for any and all risks of injury or death while participating in this activity.

I understand that it is not possible to predict every situation and condition of the terrain the mountain bike will be ridden on; therefore, it is impossible to guarantee the mountain bike I use will react safely in all riding conditions.

I realize it is mandatory that I wear a helmet at all times while mountain biking and that I obey all trail signs and remain only on open trails. If I am observed not wearing my helmet my pass may be revoked without reimbursement.

I understand that there is a 48 hours cancelation policy. If you wish to cancel within that 48 hours then we hold the right to charge you the full amount reserved for. We do not give refunds due to weather.
