Rental Equipment Agreement
Waiver and Release of Liability
Minimum Age to Rent: You must be at least 18 years of age to rent an E-Bike or Beach Bike.
Assumption of Risk: I (being the Customer) understand and accept that renting this/these bicycle(s) and participating in bicycling exposes me and the rest of my rental party to many hazards and entails the potential risk of death, personal injury (including but not limited to severe spinal, limb or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in bicycling.
I choose to participate in bicycling in spite of any and all of these risks and hereby assume all risk of injury or loss of life to myself and my rental party and the loss of or damage to property arising out of renting this/these bicycle(s) and participating in bicycling. I understand the inherent risk involved in using this equipment; accept full responsibility for any and all such damage or injury which may result.
Waiver and Release: In consideration of Carolina Shore Electric Bikes OBX LLC (C.S. E-Bikes) renting me this bicycle(s), I specifically release and forever discharge C.S. E-Bikes and its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this bicycle and participating in bicycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of C.S. E-Bikes or its officers, agents, or employees. It is my intent by acknowledging and signing the Waiver and Release of Liability i to release C.S. E-Bikes and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of C.S.E-Bikes or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me or any other member of my party involved as part of this Rental Equipment Agreement while I’m engaged in renting this bicycle(s) or participating in bicycling, I will have no right to make a claim or file a lawsuit against C.S. E-Bikes or its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage.
I hereby commit to wearing a helmet at all times while riding the bicycle.
I understand that this activity may result in severe injury, including but not limited to spinal, limb or head injury.
I understand that accessories such as child seats and trailers can change the dynamics of cycling and can create additional risks for the cyclist and the rider or passenger.
I understand that this activity may result in hazards posed by other bicycles and traffic or road conditions.
I understand how to operate the rental bicycle’s gears, brakes, electric motor and how to adjust the seat and handlebar position.
C.S. E-Bikes staff has answered any and all questions I have had regarding use of the Equipment.
I understand that traditional beach bicycles require lights for night operation per North Carolina laws and to use the bicycle at night, I have selected a light kit from C.S. E-Bikes for night-time usage of the bicycle(s) related to this Rental Equipment Agreement.
I have carefully read and understood the above. I understand this is an assumption of risk, waiver and release of liability and I sign it voluntarily on behalf of myself and the other members of the renting party to this Rental Equipment Agreement. I also understand that I should not and may not participate in this activity if I am under the influence of alcohol or drugs.

CONDITIONS OF RENTAL
Wherever user herein, the term “Equipment” shall include any and all Equipment rented from Carolina Shores Electric Bikes OBX LLC (C.S. E-Bikes). The Customer understands and agrees that the Equipment described either on our website or selected in store for rental purposes remains the property of C.S. E-Bikes and that the failure by the Customer to return said Equipment (either by releasing custody of the Equipment at the agreed rental site for pickup by C.S. E-Bikes, or by drop-off to our store at the above address if picked up by the Customer ) within the time provided in this contract may constitute a crime and subject the customer to criminal prosecution.
RESPONSIBILITY FOR DAMAGE OR LOSS:
Customer agrees he/she will return all of the Equipment rented for the individual (s) associated with this Rental Equipment Agreement in the same good condition as when received, and to replace lost, stolen, damaged or broken parts (including flat tubes and damaged tires / rims, lost recharging cables, E-Bike keys, light kits, baskets, helmets, locks, etc. ), and will allow C.S. E-Bikes to charge the customer’s credit card on file (without dispute) for the lost or damaged Equipment. (see Damage Expense Listing below).
Therefore, regardless of the party at fault, the customer understands and agrees to be responsible for the damage to said equipment.
SUBLEASING PROHIBITED: Customer understands and agrees that any subleasing or reletting of rented Equipment is prohibited and that any reletting or sublease shall immediately cause termination and cancellation of this contract.
CUSTOMER LIABILITY: Customer shall assume liability for any and all damage or loss to personal property, accident/injury to other persons related to said Equipment as detailed above. (See Damage Expense Listing below)
TERMINATION OF AGREEMENT: Customer agrees that C.S. E-Bikes has the right to terminate this Agreement at any time and retake possession of said equipment if notified that the Equipment is being used improperly by local law enforcement.
DEPOSIT:
To rent, we do not require a damage deposit for either an E-Bike or traditional Beach Cruiser bicycle rental as you the Customer have acknowledged and agreed to the terms of this Equipment Rental Agreement, including the Terms & Conditions referencing loss, theft and damage to the rented Equipment and Accessories. We do require a valid copy of the Driver’s License for the renter signing the Equipment Rental Agreement.
LEGAL COSTS:
If any action is brought to enforce any of the Terms & Conditions of this Rental Equipment Agreement, or to recover any sums due to hereunder, Customer agrees to pay attorney fees, court costs, or other expenses incurred by C.S.E-BIkes.
LATE RETURN FEE:
An additional hourly, half day or full day(s) rental fee, depending on actual time of return, will be charged for each hour, half day or full day Customer keeps Equipment after the agreed return time/date specified in the on-line booking. All equipment must be ready for pickup by C.S.E-Bikes when scheduled for pick-up. If rented from the store, the bicycles & accessories need to be returned by the specified time per the Equipment Rental Agreement.
I AGREE NOT TO RIDE OR USE RENTAL EQUIPMENT ON ANY BEACH, IN THE WATER OR LEAVE UNLOCKED OR UNSHELTERED THAT COULD LEAD TO POSSIBLE THEFT OR DAMAGE TO THE BIKE(S).
I UNDERSTAND THAT I SHOULD NOT CLEAN THE EQUIPMENT BEFORE RETURNING IT AS. C.S. E-BIKES WILL TAKE CARE OF THIS.
I ACKNOWLEDGE FULL RESPONSIBILITY FOR THE SAFETY OF MY GROUP AND AGREE THAT ALL MEMBERS WILL RIDE SAFELY AND RESPONSIBLY.
I UNDERSTAND THAT I AM RESPONSIBLE FOR MAKING ALL EQUIPMENT AVAILABLE FOR RETURN AT THE SPECIFIED TIME.
ALL EQUIPMENT RENTED (BIKES AND ACCESSORIES) AND THE COST OF ANY LOST OR DAMAGED GEAR WILL BE CHARGED TO MY CREDIT CARD.
I AGREE TO COMPLY WITH ALL CONDITIONS OUTLINED IN THIS CONTRACT.
