Customer must read and agree before signing. This form includes information about the proper use of the equipment, the costs that will be assessed if the equipment is damaged, and a release of all claims of liability against Pete's Garage, its employees, and agents in the event of injury to the customer. 

--> I have inspected the equipment I am renting and acknowledging it is in good condition unless it is otherwise noted in this agreement.

--> An employee of Pete's Garage, LLC has reviewed the operation of the equipment with me and I asked and received answers to any questions I have as to use and operation of the equipment.

--> It is my responsibility to wear a helmet while operating this equipment and acknowledge that either (1) I have been offered a helmet or (2) I have agree to provide my own.

Condition of Equipment on Return & Responsibility for Costs

I agree to return all equipment in a clean and undamaged condition. I understand that if I do not clean the equipment of mud and debris, or if I damage the equipment, I will be charged for cleaning, repairing, or replacing it. I understand that damaged parts or components will be repaired/replaced at the sole discretion of Pete's Garage, LLC and that I will be charged at retail rate for the parts and labor to correct the damage. I understand "clean and undamaged" means normal wear and tear is accepted but does not include broken or bent spokes or rims, damaged frames, handlebars or seats, or damage to any other parts or components.

Assumption of Risk

I understand and accept that bicycling is a hazardous activity. I understand that the sport of bicycling and the use of this equipment involves the risk of personal injury, including serious and severe spinal and head injuries, as well as injury or damage to property of myself or others. I also understand that I should be in good physical health to participate in bicycling. I choose to participate in bicycling knowing and accepting these risks and hereby assume all risks, injury, or loss of life to myself or others, and also loss of or damage to property arising out of renting this bicycle and equipment and participating in bicycling. I understand the inherent risk involved in using this equipment, and take full responsibility for any and all such damage or injury  which may result from my use of this equipment.

In consideration of Pete's Garage, LLC renting my this equipment, I on my own behalf and on behalf of my heirs and assigns, specifically release and forever discharge Pete's Garage, LLC, its members, store managers, employees and agents from any and all liability or claims for injury, illness, death, or loss of or damage to property which I may suffer while renting this equipment and participating in while bicycling or in any way utilizing the equipment I have rented. This discharge specifically includes, but it not limited to, liability or claims for injury, illness, death, or damage caused by my use or misuse of the equipment, even if the same is caused by the negligence of an employee, agent, manager, or member of Pete's Garage, LLC. It is my intent by this Waiver & Release to release Pete's Garage, LLC and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life whether based on breach of contract, breach of warranty, or any other legal theory.
