SKI BIKE RENTAL & DEMO WAIVER

(Sno-Go Products rental agreement/waiver)

A 10 minute grace period will be offered. After that, all late returns are subject to $100/hr late fee.

$250 refundable security deposit required per Sno-Go rental.

Children under 18 must have their parent(s) or guardian reserve/rent/pay/and be 100% liable for their participation and use of the equipment. 

Minimum age is 13.

I promise to return the rented SNO-GO equipment clean and undamaged to Stealth Tahoe LLC by the agreed time and date during the rental or demo event. I will pay for any repair, cleaning or replacement at the full retail rate as well as for the full rental value of any additional time or days beyond the agreed return date and time. I am aware of the costs for repairs, replacement and additional rental time.

I understand how this equipment works and have received satisfactory instructions. I agree to check this equipment thoroughly before each use. If, at any time, the equipment does not seem to be working properly, I will stop using it immediately and return it for inspection. I will not change, adjust or modify the equipment.

1. I understand that using the SNO-GO and related activities (hereafter “SNOW SPORTS”) are HAZARDOUS and that injuries are common and ordinary occurrences during these activities. I understand that injuries resulting from SNOW SPORTS range from minor to serious, up to and including death. I EXPRESSLY AGREE TO ASSUME ALL RISKS of INJURY or DEATH while using this equipment or participating in SNOW SPORTS,including NEGLIGENCE of others. I understand that a helmet designed for SNOW SPORTS use may reduce the risk of some types of injuries to the user at slow speeds, but that serious injury or death can result from both low and high energy impacts, even when a helmet is worn, and that a helmet must be properly fitted and worn with the strap buckled in order to be effective. I understand that many risks of SNOW SPORTS may be reduced by taking lessons, by following "YOUR RESPONSIBILITY CODE" (summarized below) and by using reasonable care and common sense. I agree to use the provided leash at all times to prevent the equipment from running away.

2. I understand how to get on and off the chairlift with the SNO-GO equipment. I understand that while the SNO-GO is designed to balance on the chairlift so that it does not slip off, I also understand that events may occur that counteract the SNO-GO’s balance. These events may be, but are not limited to: sudden stopping or starting of the chairlift or rocking of the chairlift. I agree that while I am on the chairlift, I will firmly hold the SNO-GO on the chairlift at all times. I also agree to use all safety equipment on the chairlift and that I will not do anything while on the chairlift to cause the SNO-GO to fall from the chairlift.

3. To the fullest extent allowed by law, I hereby agree to FULLY RELEASE, INDEMNIFY AND HOLD HARMLESS Stealth Tahoe LLC and SNO-GO, Wagmar Enterprises, LLC and Wagmar Technologies, LLC, any affiliated entities and/or individuals, all manufacturers and distributors of the equipment and all of their officers, members, partners, employees, agents and property owners (collectively hereafter "COMPANY"), from any and all responsibility or liability for any injuries, damages or death resulting from my participation in SNOW SPORTS or use of the equipment rented with this agreement including any NEGLIGENCE of Stealth Tahoe LLC and/or the COMPANY, breach of contract or product liability. I further agree that I WILL INDEMNIFY Stealth Tahoe LLC and the COMPANY for all attorneys' fees, costs, or judgments incurred as a result of my participation in SNOW SPORTS, use of the equipment, or the breach of this agreement. I accept this equipment "AS IS" WITH NO WARRANTIES, express or implied.

4. I hereby assign and grant to Stealth Tahoe LLC and the Company the right and permission to use and publish photographs, films, video, sound recordings and/or other media images or recordings of myself, my name and likeness before, during and after my use of the SNO-GO equipment. I specifically waive any right to any compensation I may have to the foregoing and release Stealth Tahoe LLC and the Company from any and all liability from such use and publication.

5. I will not operate or ride a Sno-Go bike under the influence of drugs and/or alcohol.

6. This document is the ENTIRE AGREEMENT regarding this transaction and is intended to provide a COMPREHENSIVE RELEASE OF ALL LEGAL LIABILITY which is binding upon all parties, their heirs, and assigns, but is not intended to release any claims that are prohibited by law. If any part of this agreement is held to be unenforceable, the remainder shall be given full force and effect. This agreement is governed by California Law.

EBIKE RENTALS

STEALTH TAHOE, LLC, dba STEALTH TAHOE, RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

Terms and Conditions for Rental and Use of Electric Bikes and Electric Biking Equipment:

 In consideration of Stealth Tahoe, LLC, dba Stealth Tahoe, hereafter referred to as Stealth Tahoe, agreeing to rent to me electric bikes and electric biking equipment and permitting my use of their services, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree to the following: 

1. To rent a class 2 or class 3 electric bike, I agree to submit beforehand a driver’s license or another valid identification, and a valid credit card. Reloadable prepaid cards cannot be accepted. Stealth Tahoe will keep my identification and credit card until the equipment is returned. Alternatively, I have the option to pay a deposit of $250.00 in cash or by pre-authorized charge on credit card. 

2. I understand that riding a bicycle requires both a good physical condition and the technical expertise of the rider. Therefore I declare, without any reservations, to possess adequate knowledge and the appropriate skills to operate an electric bicycle (class 2, class 3, etc.). In the case of children, between the ages of 15 and 18, the parent or guardian must approve their participation, accepting full responsibility on their behalf, in accordance with the regulations stated in this contract. No persons under the age of 15 years old may participate. 

3. All riders are required to wear a California Department of Transportation approved safety helmet. Any injuries resulting from a rider not wearing a helmet are the responsibility of the rider and are in no way the responsibility of Stealth Tahoe. 

4. The bicycle is to be used exclusively as a means of transport and must be treated with care, common sense and diligence, in order to avoid any damage to the bike itself and other equipment and accessories. It is strictly forbidden to use the bike for commercial purposes. 

5. I AGREE TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against Stealth Tahoe, THE EQUIPMENT MANUFACTURER AND/OR DISTRIBUTOR and to release Stealth Tahoe for any and all liability for any loss, damage, expense or injury, including death, that I may suffer, or my next of kin, or child, may suffer as a result of my participation in electric biking and the use of the equipment, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, BREACH OF WARRANTY ON THE PART OF Stealth Tahoe IN RESPECT OF THE DESIGN, MANUFACTURE, SELECTION, MAINTENANCE, INSPECTION, SERVICE OR REPAIR OF THE EQUIPMENT, or in respect to the failure of Stealth Tahoe to provide adequate directions or instructions as to the use of the equipment. I agree TO HOLD HARMLESS AND INDEMNIFY Stealth Tahoe for any and all liability for any property damage, loss or personal injury to any third party resulting from my participation in electric biking and/or use of the equipment. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity. 

6. I agree to follow all rules and traffic laws as enforced by the State of California and the local municipality where I am located. Stealth Tahoe rejects any liability for improper use of the equipment or for the user's failure to comply with the regulations and/or laws of the State of California. 

7. During the rental, Stealth Tahoe, at their sole discretion, may carry out checks with respect to the use of the equipment, and has the right to demand an early return of the equipment in case of improper use of the equipment. Stealth Tahoe may refuse service to any person they deem unfit to safely operate the equipment. If at any time, Stealth Tahoe suspects a customer is under the influence of drugs and/or alcohol or otherwise impaired, Stealth Tahoe reserves the right to confiscate the equipment. No refund will be issued to customers who unlawfully operate or misuse the equipment. 

8. In the event of loss of keys or any accessories or damages to the equipment, Stealth Tahoe may require that I pay the necessary amount to restore the equipment to its original condition, plus fees for loss of income due to the time the equipment is out of service, as is the sole judgment of Stealth Tahoe. 

9. In case of theft or total loss, I agree to compensate Stealth Tahoe with the agreed amount of the MSRP for each respective bicycle and or equipment. The equipment must be returned within the time slots indicated in the agreement, to the same place where it was rented. The equipment will be considered returned only when it is returned to a staff member of Stealth Tahoe. Leaving the equipment outside of the rental point during closing time will not be considered a proper return. Failure to return the equipment within the agreed upon time frame without prior notice to Stealth Tahoe will be considered as an act of theft and therefore the user will be reported to law enforcement. 

10. In the event of a late return of the equipment, I agree to notify Stealth Tahoe in advance that the equipment will be returned late. A late fee of $1.00 per minute may be charged to my credit card at the sole discretion of Stealth Tahoe. 

11. In the event of theft of the equipment, I agree to first notify Stealth Tahoe and then I must file a report with law enforcement and provide Stealth Tahoe with a copy of the theft report. I understand that I will be asked to pay the agreed amount (see article 9) as compensation for the stolen equipment. In the event that the equipment is found and fully recovered, this sum will be returned to me, minus any repairs that may be necessary to restore the equipment to its pre-rental condition. 

12. Cancellation Policy: Cancellations made within 72 hours of the rental date will be charged 20% of the total rental amount (includes any and all bikes and equipment).

13. I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO SIGNING IT, WHETHER THAT BE IN PERSON OR ELECTRONICALLY, AND I AM AWARE THAT AGREEING TO THE TERMS CONTAINED THEREIN THAT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ASSIGNS , OR REPRESENTATIVES MAY HAVE AGAINST Stealth Tahoe, LLC.
