Bateman's Bicycle Company

By proceeding with this rental transaction, all rental clients agree to the following release of liability. You will be required to fill out a physical copy of the waiver below when you pick up your rental.

-The renter is responsible for any damage to the rented bicycle and/or other items which occurs to within the rental duration period.

-In the event that the rented the rented bicycle and/or other items are stolen, lost, damaged beyond repair, or otherwise destroyed during the duration of the rental period. The renter will be responsible for the replacement cost of the given Items.

-Missed rental appointments may be subject to a rebooking/service fee.

-The rented bicycle and/or other items will remain the exclusive property of Bateman's Bicycle Company LTD. through the duration of the rental period and beyond, and may be repossessed at any time beyond the agreed-upon rental period.

By proceeding with the rental transaction, you agree to have fully read and understood the above terms, and agree to the general release of liability below.

Bateman’s Bike Co. Rental Waiver

In consideration of being allowed to participate in the bicycle rental (the “Activity”) and other good and valuable consideration, the receipt of which is hereby acknowledged, I ______________ (the “Participant”) of ___________ (participant address). Agree with Bateman’s Bicycle Company LTD of 49 Laird Dr, East York, ON M4G 3T4, Canada to the following:

DETAILS OF ACTIVITY

The Participant will be participating in the following activity: Bicycle Rental from Bateman’s Trail Shop, provided by Bateman’s Bicycle Company LTD.

CONSIDERATION

Being of lawful age and in consideration of being permitted to participate in the activity, the Participant releases and forever discharges Bateman’s Bicycle Company LTD, its owners, directors, officers, employees, agents, assigns, legal representatives, and successors from all manner of actions, causes of action, depts, accounts, bonds, contracts, claims, and demands for or by any reason of any injury to person or property, including injury resulting in the death of the participant, which has been or may be sustained as a consequence of the participants participation in the activity and notwithstanding that such damage, loss or industry may have been caused solely or partly by the negligence of Bateman’s Bicycle Company LTD.
The Participant understands that the Participant would not be permitted to participate in the Activity unless the participant signed this waiver.

CONCURRENT RELEASE

The Participant acknowledges that this Wasiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant by Bateman’s Bicycle Company LTD, and with the intention of binding the Participant’s spouse, heirs executors, administrators, legal representatives, and assigns.

FITNESS TO PARTICIPATE

The Participant acknowledges to the activity provider that the Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Participant from participating in the activity. If required, the Participant will obtain a medical examination and clearance.

FULL AND FINAL SETTLEMENT

The Participant acknowledges and agrees with Bateman’s Bicycle Company LTD that: (1) Bateman’s Bicycle Company LTD has given the Participant sufficient time to carefully read this waiver, (2) the Participant has been given the opportunity and has been encourages to seek independent legal advice prior to signing this waiver, (3) the Participant fully understands the risks and claims that the Participant is waiving to participate in the Activity, (4) the Participant is freely and voluntarily executing this Waiver, and (5) the Participant is forever prevented from suing or otherwise claiming against Bateman’s Bicycle Company LTD for any property loss or personal injury that the Participant may sustain while participating in or preparing for the Activity.

GOVERNING LAW

This Waiver will be governed by and construed in accordance with the laws of the Province of Ontario
