Rental Agreement Terms & Conditions
Central States Mobility, Inc. (further known herein as “Central States Mobility”) rents to the person signing this agreement (further known herein as “Renter”) mobility equipment (scooter, wheelchair, walker, rollator, ramp and etc.) and any accessories (further known herein as “Equipment”) subject to all the terms and conditions set forth in this Rental Agreement, the booking confirmation and rental invoice.
The Renter agrees: The Equipment is the property of Central States Mobility and is received in good operating condition. Renter will return the Equipment in the same condition as received at the end of the rental period. Central States Mobility may repossess the mobility Equipment without demand at any time if it is used in violation of the terms of this agreement
Personal Property
Central States Mobility shall not be liable or responsible for the loss or damage to any property left, lost, damaged, stolen, stored or transported by Renter, its agents, servants, or employees, or any other person on the Equipment, whether before or after its return to Central States Mobility. Renter assumes all risk of such loss or damage and waives all claims against Central States Mobility by reason thereof and Renter agrees to hold Central States Mobility harmless from and to defend and indemnify Central States Mobility against all claims based upon or arising out of such loss or damage. Renter assumes all risk liability for any loss, damage or injury, including death, to persons or property or Renter or others arising out of the use, operation or driving of the Equipment.
Equipment Condition
Renter is responsible for the Equipment and will reimburse Central States Mobility $1,650 for a 3 or 4-wheel transportable scooter, $1,750 for a Pride Go-Chair, $2,250 for a full size scooter, $225 for a manual wheelchair, $450 for an UPWalker, $300 for a European style rollator, $100 for a standard aluminum walker, $180 for a knee walker/scooter as the full cost of replacement upon demand for any loss, theft, or destruction of the Equipment. Ramps will be reimbursed at the manufacturers full MSRP in effect at the time of loss. Central States Mobility reserve the right to use electronic or other methods to track Equipment in case of loss or theft. Any damages will be charged at Manufacturers Suggested Retail Price in affect at the time of the rental up to the total replacement cost listed above. Renter understands and authorizes that Central States Mobility will charge the credit card used for any repair costs or the replacement costs of the Equipment. State and local sales tax will be added to these charges.
Operation of Equipment
The following restrictions are cumulative and each shall apply to every use, operation or driving of the Equipment. Under no circumstances shall the Equipment be used, operated by any person: a) under the age of 18; or b) while under the influence of intoxicants or narcotics; or c) in an unsafe manner; or d) by a person over the recommended weight capacity of the Equipment. Renter shall defend, indemnify and hold harmless Central States Mobility, all of their agents, officers, servants, and employees from and against any and all losses, liability claims, damages, injuries, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage, injury or death claimed by persons that may arise from the use, operation or driving of the Equipment, provided that such loss or damage was not caused by the fault or gross negligence and willful misconduct of Central States Mobility or its employees. Renter assumes all costs and expenses of every kind and nature, including legal fees and disbursements arising out of and in connection with the use, operation or driving of the Equipment. Central States Mobility assumes no liability or responsibility for any acts or omissions of Renter or of Renter’s agents, servants, or employees.
Damage, Loss and Theft Reporting
Renter shall notify Central States Mobility immediately of any and all accidents and damage resulting from use, operation or driving of the Equipment. Renter agrees to pay all costs, expenses, and attorney’s fees incurred by Central States Mobility in collecting sums due or in regaining possessions of Equipment or in enforcing or recovering any damage, losses or claims against Renter. Renter will notify Central States Mobility and local law enforcement immediately following discovery of theft of the Equipment. Renter will notify Central States Mobility immediately of any malfunction while in use and Central States Mobility will make effort to remedy the issue in a timely manner.
Identification and Representation
Renter shall require photo I.D to operate the Equipment with reasonable care and diligence and comply with the terms of the agreement. Renter or the driver of the Equipment shall in no event be deemed the agent or employee of Central States Mobility in any manner or for any purpose whatsoever. Any individual executing the Agreement as Renter in representative capacity shall be bound personally, jointly and severally, with such fiduciary, corporations or other entity as to all obligations, expressed or implied, arising hereunder. This Agreement shall be binding upon the distributes, heirs, next of kin, executors, administrators and personal representatives of the undersigned Renter.
Payment Policies
Central States Mobility accepts major credit cards (MasterCard, Visa, Discover Card, and American Express) for credit identification and payment at the time of rental. Central States Mobility upon delivery may require Identification such as a valid Driver's License or State issued (Non driver’s) Identification Card with picture to verify who we are delivering the item to. Debit Cards can be used only as a form of payment of rental charges. Note: Prepaid Debit/Gift cards are not acceptable methods of credit or identification. Checks/Money Orders are not accepted. Renter will be charged a 20% cancelation fee for cancellations prior to 48 hours of the rental being delivered by or picked up at Central States Mobility. Cancellations inside 48 hours of the rental start time will be charged 100% of the standard minimum rental period.
Rental Extensions and Returns
Equipment and any included accessories are due back at the date/time specified on the rental agreement so the Equipment can be picked up. If you need to extend your rental, you must call prior to expiration date and time to determine if the rental can be extended. Central States Mobility may, at its own discretion allow or deny any extension. Central States Mobility reserves the right to charge the Renter’s card and Renter agrees to allow the additional charge for each additional day or fraction of a day the Equipment is kept by the Renter beyond the prearranged return date and time on the rental contract. A $35 fee will be applied for return trips to pick up rental items if not returned at the agreed upon time as listed in the rental reservation or prior agreed upon written arrangement for return. Renter may request a change of product for reasons of size or transportation issues; the approval of the request is at the sole discretion of Central States Mobility and will be based on the availability of equipment and delivery personnel. A $35 fee applies to any exchanges.
The agreed rental dates, times and Equipment being provided are included in your reservation confirmation and your invoice.
If any provisions hereof or the application of any provisions to any person or circumstance is held invalid or unenforceable, the remainder hereof and the applications of such provision to other persons or circumstances shall remain valid and enforceable.
The terms & conditions outlined above have been reviewed and accepted as part of the rental agreement.
