1. I accept FULL RESPONSIBILITY for the care of the equipment rented while it is in my possession.

2. I will be responsible for the REPLACEMENT at FULL RETAIL VALUE PLUS ANY LABOR COST of any equipment rented under this form and not returned to SUBCULTURE CYCLERY - 129 NORTH G ST., SALIDA, CO 81201.

3. I agree to RETURN all rented equipment by the agreed date and time in THE CONDITION IT WAS RECEIVED to avoid an additional DAY RENTAL CHARGE.

4. I agree to a 25% CANCELLATION FEE, and all cancellations must take place at least 48 hours before the reservation. No cancellations will be excepted within 48 hours of the reservation day YOU WILL BE CHARGED THE FULL AMOUNT.

5. I have received instruction on the use of my equipment and fully understand its use and function.

6. I agree to WEAR A HELMET AT ALL TIMES while using the rented equipment. If I don’t have a helmet, I will ask for a rental helmet to be provided.

7. I agree to hold harmless and indemnify SUBCULTURE CYCLERY and its owners, agents, and employees, as well as the equipment’s manufacturers and distributors for any loss or damage, including any that results from claims from personal injury, death, or property damage related to the use of this equipment.

8. I understand that there are inherent and other risks involved in the sport of bike riding, for which this equipment is to be used, that injuries are a common and ordinary occurrence of the sport, and I freely, and voluntarily assume those risks. I also understand the increased risks associated with riding bicycles, its enhanced performance and the riders propensity for traveling at increased speed as a result.

9. I hereby release from any legal liability SUBCULTURE CYCLERY and its owners, agents, and employees, as well as the manufacturers and distributors of this equipment from any and all liability for damage and injury or death to myself or to any person or property resulting from the selection, installation, maintenance, adjustment, or use of this equipment and for any claim based on negligence, breach of warranty, contract or other legal theory, accepting myself the full responsibility for any and all such damage, injury or death which may result in OTHER WORDS, I ACCEPT THIS EQUIPMENT, LISTED ON THIS FORM, AS IS.

10. This agreement is governed by the applicable law of this state or province. If any part of this agreement is determined to be unenforceable, all other parts shall be given full force and effect.

11. I UNDERSTAND THAT BIKE THEFT IS AN ISSUE IN AND AROUND CHAFFEE COUNTY. I WILL NOT LEAVE THIS BIKE UNATTENDED DOWNTOWN OR ANY OTHER PUBLIC SPACE. A CABLE OR U-LOCK WILL NOT PROTECT THIS BIKE FROM THEFT. YOU ARE RESPONSIBLE FOR THE SAFETY OF THIS BiKE FROM THIEVES!
