Term and Conditions

I agree to receive instruction on how to operate the bike on the test ride and I agree to not ride the bike until I understand how to ride the bike and operate its brakes and shifters in a safe manner.

I will not make any adjustments to the bike during the ride unless assisted by a salesperson. I agree that any adjustments made outside of this agreement may be subject to readjustment by a shop technician at my expense.

I understand that I am subject to State laws applicable to bikes/ebikes and I will obey them during the duration of the rental and I will keep a lookout for motor vehicles and other hazards during the ride.

I am the parent/guardian of the minor rider and have witnessed him/her being instructed on the items listed above and I am signing on his/her behalf.

I accept responsibility for any damage done to the bicycle beyond normal wear and agree to pay the cost of necessary repairs if such damage occurs. Costs of said repairs would include cost or parts and labor time at prevailing shop rates.

I understand and am aware that bicycling is a hazardous activity. I understand that the sport of bicycling and the use of bicycling equipment involves a risk of injury and that I am voluntarily participating in these activities with the knowledge of the danger involved. I hereby agree to expressly assume and accept any and all risks of injury or death to the user of this equipment and to any other person.

I agree that I own a bicycle helmet or that I wish to rent or purchase one and that I will wear it at all times while riding the rental bicycle.

I agree that I discharge this shop from any and all responsibility or liability for injuries or damages to the user of this equipment listed on this form or to any other person. I agree to release this shop from any such responsibility and liability whether it results from the use of this bicycle, inspection or adjustment of this bicycle by the shop or whether it results from the negligence (active or passive), or strict product liability of this shop.

I understand that there are fees if I lose/damage any items included in the rental.

I have carefully read the Terms and Conditions and fully understand its contents. I am aware that this is a release of liability and a contract between myself and Bingham Cyclery and I sign it of my own free will.
