Lessor makes no representation, covenants, or warranties, express or implied with respect to condition, quality, suitability, or fitness for any particular purpose of the leased by this Agreement, except that Lessor warrants that it will have title to each item of property delivered to Lessee. With respect to Lessor's duty to you, it is expressly agreed that you agree to lease the property "AS IS". Lessor shall not be liable for damages or losses caused by failure of the property to operate or faulty operation of the property. If any of the leased property becomes lost, stolen, destroyed or damaged beyond repair, you will be liable for the loss of damages, and you may pay the lessor any and all amounts necessary to repair or replace the leased property. By signing this Agreement, you fully realize the dangers inherent in bicycle riding and assume any and all risks associated with such participation including any and all risks associated with acts of God. By signing this Agreement, you hereby waive, release and discharge for yourself, your heirs, executors, administrators, legal representatives, assigns and successors in interest any and all rights, claims, and damages which may be sustained by you directly or indirectly in connection with, or arising out of, the property leased pursuant to this Agreement. Please note that rental durations are based on a day rate that is defined by an end-of-day return. A bike rented for one day is picked up and dropped off on the same day. If a two-day rental is selected, the bike needs to be dropped off by the end of the second day. A rental "day" is not a 24-hour period from the time of pick up. We highly recommend purchasing Damage Protection. Mishaps do happen. The most common damage on rental bikes are slashed tires, bent wheels, damaged derailleurs, ripped grips, broken saddles & seat post droppers. Damage Protection covers one rental bike. Protection can be purchased either online when reserving your bike or at the shop prior to leaving with the bike. Three levels of Damage Protection:Basic $30: covers up to $250 in damage. Premium $50: covers up to $500 in damage. Platinum $75: covers up to $750 in damage.Any damage to the bike above the coverage limits or any damage to the bike in the event Damage Protection is not purchased is the financial responsibility of the rider and must be paid in full upon return of the rental bike. Damage Protection does not cover theft of the bike while in your possession. Bikes are due by the end of the business day on the last day of the rental. If a rental bike is returned late, the additional day(s) of possession will be charged in addition to a penalty equal to one day of rental. Customers can cancel a reservation by calling the location renting the bike(s). Please leave a message if a call is made outside business hours. Phat Tire will provide a full refund if a reservation is cancelled at least 24 hours prior to the reservation. 50% of the reservation cost will be refunded if the cancellation is made within the 24 hours prior to the start of the reservation. In the event of a reservation “no show”, the full price of the rental will be charged and no refunds will be made. By signing this Agreement, you acknowledge that you have read this Agreement, understand that it is contractually binding and agree to be legally bound by it.
