Gerk's Ski and Cycle Bicycle Rental Terms and Conditions
By renting a bicycle from Gerk's Ski and Cycle, you agree to the following terms and conditions:
1. Rental Agreement
- The rental period begins at the time the bicycle is picked up and ends when it is returned to Gerk's Ski and Cycle.
- Renters must provide a valid photo ID and a credit card at the time of rental.
2. Rental Fees
- Rental fees are charged per day, or multiple days, depending on the selected plan.
- Payment must be made in full at the time of rental.
3. Security Deposit
- A security deposit may be required, which will be refunded upon the return of the bicycle in good condition.
4. Bicycle Condition
- Renters are responsible for inspecting the bicycle before use and reporting any existing damage.
- The renter agrees to return the bicycle in the same condition as it was rented, excluding normal wear and tear.
5. Responsibilities of the Renter
- The renter must wear a helmet while riding (helmets are available for rent or purchase).
- The renter must adhere to all local laws and regulations regarding bicycle operation.
6. Liability Waiver
- Gerk's Ski and Cycle is not liable for any injuries, accidents, or damages incurred during the rental period.
- Renters agree to indemnify and hold Gerk's Ski and Cycle harmless from any claims arising out of their use of the bicycle.
7. Cancellation Policy
- Cancellations must be made at least 24 hours before the rental date for a full refund.
- No-shows or late cancellations may incur a fee.
8. Damage and Theft
- Renters are responsible for any damage or loss of the bicycle while it is in their possession.
- In the event of theft, the renter must report it to the local authorities and provide a copy of the police report to Gerk's Ski and Cycle.
9. Age Requirement
- Renters must be at least 18 years old. Minors must be accompanied by a parent or guardian.
10. Governing Law
- These terms and conditions shall be governed by the laws of Washington State, without regard to its conflict of law principles.
11. Changes to Terms
- Gerk's Ski and Cycle reserves the right to change these terms and conditions at any time without prior notice.

Exculpatory Agreement and
Release
It is
expressly agreed that the use and/or operation of any Dreher Sports Inc /
Gerk's Ski and Cycle (hereinafter referred to as "Gerk's") bicycle
and equipment by the undersigned (hereinafter referred to as "user")
is at the user’s sole risk., and user assumes any risk from the use and/or
operation of any Gerk's bicycle and equipment. It is further expressly agreed
that Gerk's and its directors, officers, representatives, and agents (including
but not limited to any entity acting as a Gerk's pick-up/drop-off point) shall
not be liable for any claims, demands, injuries, damages, and actions or causes
of action whatsoever to the user or any other person arising out of or
connected with the use and/or operation of any Gerk's bicycle and equipment.
User holds Gerk's harmless and does hereby expressly forever release and
discharge Gerk's from any and all claims, demands, injuries, damages, actions
or causes of action, and from all acts of active and passive negligence on the
part of Gerk's.
The user
hereby agrees that this rental period will start and end at the times and
dates listed below, and also agrees to return
to
Gerk's pick-up and drop-off location on the day the rental ends. The
renter also agrees to return the rented bicycle and
equipment
in the same order and condition in which they were received, and agrees to be
financially responsible for loss or
damages
to the bicycle(s) and equipment rented under this agreement, up to the full
amount of replacement cost and related
recovery,
repair, and/or procurement expenses. The renter agrees that the credit card
used to secure this rental will be charged to
cover such expenses.
