BOOKING CONDITIONS

• MINORS (under 18) must be accompanied by an adult
• Bike Manufacturers weight limit is 280lbs. / 122.5kg.

PAYMENT CONDITIONS

Full payment is required to hold your rental. 

We reserve the rights to charge reasonable charges in the case of bikes and/or equipment left or returned damaged. You are responsible for any costs incurred and sustained in replacing or repairing (whichever the cheaper) the items concerned to a condition equivalent to that prior to the Rental.  In all cases Normal wear & tear as defined by the products manufacturer or supplier is accepted & allowed and is included in any rental price.

• I understand that the bike is due back by 3pm. A late fee will be charged upon a late return.
• I understand the bike shall be returned in similar condition as when received. If the bike is returned with excessive mud, sand, salt water or grime there will be an excessive cleaning fee assessed.
• A credit card and valid driver’s license, or passport is required for rental pick-up.

CANCELLATION & REFUNDS POLICY

• No refunds will be given for cancellation on the day of your reservation. 
• No refunds be given for returning any bikes before the date and time agreed upon.
• No Refunds within 48 HOURS FROM THE CHECK-IN TIME OF THE RENTAL a reservation cannot be cancelled, and the full amount of the cost of the rental will be charged.
• Reservations made inside the 48 hours prior to the start of the activity cannot be cancelled, and the full amount will be charged to the credit card account on file, regardless of the client's participation in the activity, or not.

RAIN POLICY

To protect our local trail systems and our rental equipment we reserve the right to cancel/reschedule any reservation due to poor weather without notice. (no cancellation fee will be charged)

BIKE RENTAL CONTRACT

Bikes and Equipment can only be hired from Maui Sunriders Bike Co. (hereinafter referred to as ‘We’) with a completed booking and signed Waiver plus Terms & Conditions.

A Booking is made by the Hirer (hereinafter referred to as 'You') by submitting your completed Booking Form either on line at www.mauisunriders.com or in person at the Maui Sunriders Bike Co. premises along with your full payment. Upon acceptance of your completed Booking full payment a binding contract is formed between You and Maui Sunriders Bike Co. ('We' hereafter) on the terms and conditions set out below.  We reserve the right not to accept or fulfill a Booking, in which case any payment will be refunded.  When a Booking is made by one person on behalf of another person or other people (as the case may be), the person making the Booking confirms that he or she has the authority to make such Booking on behalf of the other person(s), regardless of age.  The Hire Period commences on the day the bike(s) and equipment is collected and continues until the bike(s) and equipment is returned.  

YOUR RESPONSIBILITIES

1. You are responsible for ensuring that you are physically fit enough to undertake cycling any distance using the bike(s) you have reserved.  We do not accept any responsibility for your failure to complete your rental period or chosen route due to lack of fitness, illness or injury.  We will not accept any liability for death, personal injury, loss or damage to personal effects (of/to any participant), nor can We accept any responsibility for delays or changes to your period of Rental or Tour due to weather or other factors outside our control. 
2. You accept that cycling on a public highway, cycle route, thoroughfare or track carries its own risks, and you have made your Booking on the basis that you undertake the Rental at your own risk.  You understand and accept that We advise the wearing of cycle helmets at all times during your rental and provide a selection of helmets, the wearing of which helmet is at the discretion of the Hirer and rider and We take no responsibility for ensuring or guaranteeing fit of aforementioned helmets. 
3. You will ride your cycle responsibly at all times. You will not hold Maui Sunriders Bike Co. responsible for any loss, damage or injury including death to persons or property with regard to use of the bike(s) and equipment rented.  You accept responsibility to indemnify Maui Sunriders, its employees, associates or agents, against any claim, interest, demand or expense in respect of any such injury or damage.
4. You are responsible for all bikes and equipment rented and it is your responsibility to keep the same safe from damage, loss or theft, use it in a proper manner and not subject it to any misuse or unfair wear and tear. Rental equipment must be returned in the same condition that you received it in. If you DAMAGE OR LOSE EQUIPMENT, you will be responsible for the replacement costs of the equipment damaged or missing. Understand that damage can happen while transporting a bicycle and that you need to transport the equipment in a safe non damaging manner. 
   
5. You will notify Maui Sunriders Bike Co. immediately of any loss, damage or theft to the hired cycles or equipment however caused.  You will be responsible for paying reasonable costs of reparation of any such loss, damage or theft. You will be responsible for notifying the police within 24hrs of any theft and obtaining a police statement to such effect. A copy of this report will be given and held by Maui Sunriders Bike Co.
6. You will not offer for sale or otherwise part with possession of the hired cycle(s) or equipment.
7. You will ensure that you have suitable insurance coverage, (trip insurance, credit card insurance, homeowners/renters, or be able to cover any damage or replacement values during your rental period.
8. You will return the rented bike(s) by 3:00 PM local time on the last day of your rental agreement. Failure to return the cycle(s) by 3:00 PM could lead to additional rental charges.

I, for myself and any children for which I am parent, legal guardian, or otherwise responsible; release Maui Sunriders, its agents, and employees from any liability for damage or injury to myself or any person or property resulting from negligence, adjustment, selection and use of this equipment.

I understand the risk involved in using this equipment. I accept full responsibility for any and all such damage or injury which may result. I accept for use as is, the equipment is in good condition, and accept full responsibility for equipment care while in my possession. 

I will be responsible for the prompt reimbursement of all rental equipment not returned, or damaged while in my possession, judged at the discretion of Maui Sunriders Bike Co.
