UBC Bikes Rental Waiver Policy
PLEASE
READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF
CERTAIN LEGAL RIGHTS.
I agree
and understand that mountain biking is a HAZARDOUS activity with varying
surface and environmental conditions. I understand mountain biking is different
than road biking. Further, I recognize that there are risks including, but not
limited to, rocks of various sizes, uneven and/or slippery trail conditions,
varying slopes, variations in terrain, bumps, stumps, forest growth, loose
gravel and dirt, wet surfaces, holes, downed timber, debris, other bikes and
vehicles, and other hazards and obstacles. I must regulate my speed in order to
negotiate trails and avoid such obstacles. Nonetheless, I voluntarily elect to
participate in the aforementioned activity.
By
execution of the Liability Release, I hereby acknowledge and expressly
represent that:
1. I
recognize that falls and collisions are a common occurrence with this activity
and I assume all risks and responsibility for such incidents and
injuries.
2. I
understand that HELMETS ARE REQUIRED and MAY reduce the risk of head injury,
and I agree to wear a helmet at all times. If I sustain any injuries as a
result of any of the aforementioned risks and hazards, I AGREE TO NOT SUE UBC
Bikes, Inc.
I agree
to accept “as is” the equipment listed on this form and I accept full
responsibility for the care of this equipment and I agree to pay UBC Bikes,
Inc. for any loss or damage, other than reasonable wear, resulting from use.
I
warrant that I have received instruction in the safe and proper use of the
equipment listed on this form. I warrant that I understand how to use the
brakes and shifting mechanisms on the bicycle. I have visually checked the
bicycle and received it in good working condition. I understand that the
bicycles are equipped for daytime riding ONLY, and any use of the bicycle after
dark is not recommended and is at my own risk.
This
release shall be binding upon the assignees, subrogors, distributees, heirs,
next of kin, executors and administrators of the undersigned and may be pled by
UBC Bikes, Inc. as a complete bar and defense against any claim, demand, action
or cause of action by or on behalf of the undersigned.
In the
event any section of this Release is found to be unenforceable, the remaining
terms shall be enforceable.
This
Release shall be binding to the fullest extent permitted by law.
I HAVE
READ THIS AGREEMENT AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT. I AM
AWARE THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND UBC
BIKES, INC. AND ITS EMPLOYEES.
CANCELLATION
POLICY.
If you
cancel your reservation less than 24 hours before your specified pickup time
you will forfeit 25% of the total charge. If you are more than 30 minutes late
to pick up your reservation, we will consider the reservation abandoned
and YOU AGREE to forfeit 100% of the amount.
EQUIPMENT
DAMAGES
Damage
can occur during your ride, by accepting the terms YOU AGREE to pay UBC Bikes,
Inc. for any damages caused to the rented item. YOU AUTHORIZE UBC Bikes, Inc.
to charge the card on file to pay for any damages you may have caused. The
replacement cost of the damages will be set by UBC Bikes, Inc; charges will NOT
exceed normal market value.
DAMAGE
PROTECTION POLICY
When
Damage Protection is purchased it covers any damages to the bike that may occur
up to 1,000.00. Damage Protection must be purchased for each bike during the
rental period. Damages to the bike need to be reported when returning the bike.
