ASSUMPTION OF FINANCIAL RESPONSIBILITY 

I agree and accept full financial responsibility of my rental.  I agree to cancel my reservation 24 hours or more prior to departure date & time.  I agree and understand that if I do not cancel within the time period stated above, I will willingly pay for my rental reservation in full.  I waive the right to dispute charges with my bank and accept charges made for price of entire rental reservation.  I understand I willingly made my reservation on my own, entered my credit card information with full intent to pay the full amount of my reservation. I understand that my reservation prohibits anyone else from renting the equipment from the date my reservation was made until the end of my rental, therefore I understand fully that I will be charged if I do not cancel in the time frame stated above.  

Assumption of Risk: I understand and accept that renting this bicycle/trailer and participating in biking exposes me and/or my minor children to many hazards and entail unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property.  I also understand I should be in good physical health to participate in bicycling.  I choose to participate in bicycling in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of property arising out of renting this bicycle and participating in bicycling. I understand the inherent risk involved in using this equipment; accept full responsibility for any and all such damage or injury which may result. 

Waiver & Release:  In consideration of Hawaiian Wahine, Inc. / Hele On Kauai Bicycle Rentals renting me this bicycle, I specifically release and forever discharge Hawaiian Wahine, Inc. / Hele On Kauai Bicycle Rentals and its officers, agents & employees from any and all liability or claims of injury, illness, death or damaged cause by the negligence of Hawaiian Wahine, Inc. / Hele On Kauai Bicycle Rentals or its officers, agents & employees. It is my intent by the Waiver & Release Agreement to release Hele On Kauai Bicycle Rentals or its officers, agents & employees and hold harmless from all liability from any such property loss or damage, personal injury, or loss of life, weather caused by negligence of Hele On Kauai Bicycle Rentals or its officers, agents & employees, or weather based upon breach of contract of warranty, or any other legal theory. 

Helmet Use:I REALIZE THE IMPORTANCE OF WEARING A HELMET AND I HEREBY COMMIT TO WEARING A HELMET AT ALL TIMES WHILE RIDING A Hawaiian Wahine, Inc. / Hele On Kauai Bicycle Rentals BICYCLE.  IF I CHOOSE NOT TO WEAR A HELMET, SIGNING THIS DOCUMENT STATES THAT IT IS MY CHOICE AND I AM RESPONSIBLE FOR ANY AND ALL CONSEQUENCES RESULTING FROM MY DECISION.

Damages& Costs:  I UNDERSTAND AND AGREE TO PAY FOR ANY & ALL DAMAGES TO THE EQUIPMENT I RENTED.  BIKE REPLACEMENT COST $500 EACH BIKE- LOCK OR KEY LOST $25, DAMAGED BIKE PARTS SUBJECT TO CHARGES AT BIKE SHOP DISCRETION.  I UNDERSTAND AND AGREE TO SECURE BIKE BY PLACING INDOORS FOR STORAGE. 

Cancellations made within 24 hours prior to tour departure will be charged at the full price of your reservation. Cancellations made within 48 hours prior to tour departure will be charged a 20% cancellation fee. Cancellations that are made outside of the 48-hour cancellation policy are subject to a full refund. HELE ON KAUAI BIKE RENTALS reserves the right to cancel tours due to inclement weather, foreseeable hazards, insufficient bookings or events beyond our control. In these events, full refunds will be offered. Please check your booking information carefully to ensure that all information is correct and that we have answered all your questions.  No Shows will also be charged at full reservation price.

Please note. This is a fixed rule. There will be no exceptions. 

I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT.  I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY.  I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
