PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.

I agree and understand that snow sports are HAZARDOUS activities with varying surface and environmental conditions. Further, I recognize that there are risks including, but not limited to: variable snow conditions, rocks, (various sizes), uneven and/or slippery conditions, varying slopes, variations in terrain, bumps, stumps, forest growth, loose gravel, dirt, wet and icy surfaces, holes, downed timber, debris, wildlife, other skiers/snowboarders, vehicles, and other hazards and obstacles. I must regulate my speed in order to negotiate terrain and avoid such obstacles. Nonetheless, I voluntarily elect to participate in the aforementioned activity. 

By execution of the Liability Release, I hereby acknowledge and expressly represent that: 

1. I recognize that falls and collisions with pedestrians, other riders, aforementioned obstacles, hazards and vehicles do occur with this activity and I assume all risks and responsibility for such incidents and injuries.

2.  If I sustain any injuries as a result to any of the aforementioned risks and hazards, I AGREE TO NOT SUE GALLATIN ALPINE SPORTS.

I agree to accept "as is" the equipment listed on this form. I accept full financial responsibility for the equipment listed on this form. I promise to return it clean and undamaged by the agreed time and date, and if I fail to do so, I will pay for it's repair, cleaning or replacement at the full retail rate, as determined by GALLATIN ALPINE SPORTS, as well as for the full rental value of any additional days. 

I understand how this equipment works and have received instructions and satisfactory answers to any questions.   I agree to check this equipment before each use (including the binding anti-friction device); and if at any time this equipment does not seem to be working properly, I will stop using it immediately and return it for inspection and possible repair or adjustment.  

I understand proper bindings settings depend upon the accuracy of my statements about weight, height, age, and skier type. I have confirmed the binding release/retention settings on this equipment correspond to my statements. 

If this equipment is to be used by someone other than me, I certify I am acting as agent for the user and provide all pertinent warnings and information to the user.  

This release form shall be binding upon the assignees, successors, distributes, heirs, next of kin, executors and administrators of the undersigned and may be used by GALLATIN ALPINE SPORTS as a complete bar and defense against any claim, demand, action or cause of action by or on behalf of the undersigned. 

In the event of any section of this Release is found to be unenforceable, the remaining terms shall be enforceable.

This release shall be binding to the fullest extent permitted by law. 

I HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT. I AM AWARE THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND GALLATIN ALPINE SPORTS.
