Wherever used herein, the term “equipment” shall include any equipment rented from The Okoboji Cyclist, its agents, servants, and employees shall not be responsible for personal injuries or property damage, loss or delay incurred by any person arising out of the act of negligence of any direct or supplemental carrier or other person rendering any of the services or products being offered in these rentals; nor shall The Okoboji Cyclist be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of The Okoboji Cyclist, or of any agent or supplier, or due to force majeure. Renters follow any suggested itinerary at their own risk and agree not to hold The Okoboji Cyclist or Huseman Enterprises, Inc. responsible for injury or death resulting from accidents. We strongly recommend the use of approved helmets whenever mounted on a bicycle. Helmets are provided with every rental, and you agree to wear said helmet at all times you are on the bike. The bicycles provided for use are in satisfactory operating condition and participants agree to use them at their own risk or call deficiencies to the attention of a company representative. Individual bike specifications are subject to change based on availability of replacement components. Instruction in the use, assembly and maintenance of bicycles will not be provided and participants affirm that they are competent and familiar with the use of a multi-speed bicycle.
DELIVERY AND COLLECTION Delivery and collection service is subject to approval by management at delivery and collection location, our courier provider and The Okoboji Cyclist. All delivery and collection locations should have a staffed reception and local contact phone number. Renters are responsible for ensuring that management at their accommodation is agreeable to accepting bike delivery and providing safe storage for bikes pending the renters arrival. Similarly, renters are responsible for ensuring that management at the designated collection address are agreeable to safely storing bikes and handing them over to our courier service. MAINTENANCE, TUNING AND RESPONSIBILITY All our bikes are professionally serviced before dispatch, however, some bicycles may need tuning or maintenance during the course of the rental period; such maintenance will be carried out at the renter's expense. The Okoboji Cyclist will NOT cover the cost of damages due to equipment failures beyond the Okoboji Expedition's control; i.e. damage occurred during transport or worn parts. Any deficiencies must be communicated to The Okoboji Cyclist within 24 hours of receipt of the equipment. To be eligible for a refund on such parts and service, you must provide The Okoboji Cyclist. with a photo of the damaged or worn parts. The Okoboji Cyclist is responsible for structural deficiencies such as damaged frames, worn bottom brackets, suspension and wheel hubs. The Okoboji Cyclist is not responsible for the following occurrences during bike rental: gear tune ups / punctures / broken spokes / broken chains / broken derailleurs / broken drop-outs / wheel rim damage / torn saddles / damage beyond the control of The Okoboji Cyclist and resultant of rider use or misuse.
RESPONSIBILITY FOR DAMAGE OR LOSS Customer agrees he/she will return the equipment in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken bicycles or parts or to reimburse Cycling-Rentals for said equipment. Therefore regardless of the party at fault, customer understands and agrees to be responsible for the theft or damage to said equipment.
SUBLEASING PROHIBITED Customer understands and agrees that any subleasing of rental equipment is strictly prohibited and that any such sublease shall immediately cause termination and cancellation of this contract. CUSTOMER LIABILITY Customer shall assume liability for any and all damage or loss of and to personal property, accident / injury to other persons related to said rental equipment. PERSONAL INSURANCE The Okoboji Cyclist does not provide a personal accident insurance policy. We strongly recommend that you always carry a personal or travel insurance policy.
THEFT AND DAMAGE INSURANCE You may pay an additional Theft & Damage insurance fee which in case of theft or damage to the bicycle will reduce payments by half those on our Price List. In case of theft a formal Police Report must be lodged and a copy must be forwarded to us in order to activate the insurance. In case of damage a photo must be provided to us. PAYMENT TERMS Bike rental: Upon confirmation, a deposit of the price of the rental per bike is requested to secure your reservation. This deposit is applied to your invoice and the remaining balance is payable upon return of the bike. In the event of a cancellation, a fee of $25 will be charged. We may require a damage deposit in the form of credit card charge plus the driver’s license / photo ID of one member of the party. Any deposit given by the customer shall be applied to and guarantee the faithful performance of all the provisions of this agreement and all repairs necessary to said equipment. If any action is brought to enforce any of the terms of conditions of this agreement, or to recover any sums due to hereunder, customer agrees to pay all legal fees, court costs, or other expenses.
CANCELLATIONS, ALTERATIONS, AND REFUNDS Bike rentals: As part of our Customer Commitment for those who book rentals online with us, you are entitled to a Risk-Free cancellation policy. Risk-Free Cancellation means that after you have booked your rental, you have up to 24 hours after booking to cancel it for any reason and receive a full refund with no fees. Any cancellation received for a booking after the initial 24 hour window CAN be cancelled, but will receive a $25/bike cancelation fee. Cancellations made on the date of booking are eligible for a 50% refund of the total booking cost. All applicable refunds will be issued upon return of all rented equipment.
MODIFICATIONS, ALTERATIONS, and ADJUSTMENTS: this includes moving a booking, removing a bike from a current booking, or altering your current booking time/date. Any modifications made to a current booking will receive a $25 change fee. After paying the $25 change fee, the remaining value of your old booking will apply towards the cost of your new booking.
LATE RETURN FEE : An additional day’s rental fee will be charged for each day customer keeps equipment after the return date specified on this contract. All equipment must be returned directly to The Okoboji Cyclist (922 Okoboji Cyclist, Milford, IA 51351) or wherever agreed. TERMINATION OF AGREEMENT: Customer agrees that The Okoboji Cyclist. has the right to terminate this agreement at any time and retake possession of said equipment and for said purpose The Okoboji Cyclist may enter upon the premises of the customer without becoming liable for trespass.
