Owenhouse Cycling

IMPORTANT

Be sure that you read and completely understand this document before you agree. This document, including the waiver and release of liability, affects your legal rights including your right to compensation in the event of personal injury.

You shall not be under the influence of drugs/alcohol while riding rental bikes.
You shall not bring rental bikes on chairlifts.
You shall not ride rental bikes at lift operated bike parks.
Renters will be charged up to twice the original rental amount if they are found accessing bike parks with rental bikes.
You shall not change, modify, or swap parts on rental bikes.
You shall not let anyone who has not signed an Owenhouse rental agreement to ride a rental bike.
You shall wear all proper safety equipment such as a helmet while using rental bikes.
You shall use recognized means of transport such as bike racks and tailgate pads in good working condition.
You shall not ride in excessively muddy conditions.
Excessively muddy bikes will incur an additional $20 cleaning fee. Bikes will be deemed excessively muddy at Owenhouse Cycling’s discretion.
You shall ensure that rental equipment is sufficiently protected from theft.
You shall be obligated to pay the full retail price of any bikes or equipment lost or stolen including helmets, locks, chargers, and components.
You shall return bikes on time during Owenhouse Cycling’s operating hours.
Bikes returned late are subject to fees of up to twice the original rental price in addition to extra rental days.

DAMAGE RESPONSIBILITY

I accept responsibility for any damage done to the equipment, and agree to pay the cost of needed repairs – including by not limited to: labor, parts, shipping costs, etc. Evaluation of such damage would be the sole discretion of Owenhouse Cycling.

Notice: Due to the amount of wear and tear our rental bikes have received when being loaded onto and off of lifts, as well as the severity of the extreme downhill trails at the resorts, our rental bikes are not to be used in lift-access areas. This includes Big Sky Resort and Discovery Resort. If our rental bikes are discovered at any lift access park, fines of up to double the initial rental cost will be applied in addition to damages. If you wish to rent a bike for riding in lift-access areas please contact the resorts for rental options.

ACKNOWLEDGMENT OF RISKS, WAIVER, AND RELEASE OF LIABILITY

I understand and am aware that riding bicycles is an inherently dangerous and risky activity. I understand that bicycling and the use of any bicycling equipment involves risk of serious injury or death and I am voluntarily participating with knowledge of the dangers and risks involved. I am aware that bicycling has inherent dangers and risks, which include, but are not limited to: loss of control, collisions with other vehicles including automobiles, animals, vegetation, and other man-made or natural obstacles, failure of equipment, rough roads and hazardous off-road trail conditions including soft sand, loose rocks, steep grades, drop-offs, falling rocks, dangerous wildlife, changing weather conditions, and other natural forces which may be encountered without warning. I am aware that bicycling in unpopulated areas involves the previously listed inherent risks and additional risks, including but not limited to: extended hiking or climbing, being separated from the group, difficulty in communication, unavailable medical treatment, and water or other supplies. I hereby voluntarily assume these inherent risks, whether known or unknown, and acknowledge that I am legally responsible for all injury or death and for all damage to my property that may result from these inherent risks.

I agree that I release, discharge, and hold harmless Owenhouse Bicycling, Owenhouse Ace Hardware, and Owenhouse Hardware Co. from any and all responsibility or liability for injuries or damages of any kind of nature to me or any other person resulting from my use of the equipment listed in this form.

By signing this document you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider's ordinary negligence that are the result of the provider's failure to exercise reasonable care.
