1 - Renter agrees to pay all rates and charges, including applicable taxes, which may apply to the Equipment rental. Renter understands that all charges are based on the time the Equipment is in renters possession whether or not in use.

2 - Renter understands that Renter must deposit an amount equal to the estimated total charge for the Equipment rental at the rates indicated in this Agreement. Renter authorizes Company to bill all amounts actually due from Renter to Renter's credit card.

3 - No person other than Renter may ride, drive or otherwise operate the Equipment and Renter may not carry any passengers on the Equipment. Renter will operate the equipment in a careful, safe and conscientious manner and will at all times observe and adhere to all applicable rules, regulations, and laws.

4 - Renter may not make any unauthorized repair or modifications to the Equipment. Renter will return the Equipment to Company for the repair of any part of the Equipment that is not functioning normally.

5 - Renter has examined the Equipment and found it to be in good, clean condition. Renter agrees to return the Equipment to Company in the same condition as received on the due date and time specified in this Agreement. Renter understands that there will be additional charges if Renter returns the Equipment late.

6 - Company may terminate this Agreement and repossess the Equipment at any time without any obligation to refund any amounts paid by Renter to Company if (i) Renter fails to return the Equipment when due, (ii) the Equipment is used in an unsafe or reckless manner or in violation of law, (iii) it appears that the Equipment is abandoned, (iv) the Equipment is used in violation of this Agreement, or (v) Renter made any misrepresentation to Company.

7 - Renter shall be responsible for all losses of and/or damage to the Equipment (including by reason of theft or vandalism), regardless of fault. If the Equipment is damaged, Renter agrees to pay the reasonable costs of repair and diminution in value, if any, of the Equipment. If the Equipment is not returned, lost, stolen or damaged beyond reasonable repair (as determined by Company in its sole discretion), Renter shall be responsible for, and shall pay to the Company, the retail market value of the Equipment.
