Terms & Conditions of Rental

Wherever used herein, the term “equipment” will include any equipment rented from Station Street Cycle Shop, LLC (SSCS), including any parts, components or attachments thereto. The renter understands and agrees that the equipment described in this contract remains the property of SSCS and that failure by the renter to return said equipment to SSCS within the time provided in this contract may constitute a crime and subject the renter to criminal prosecution as well as breach of this contract, with potential civil penalties and judgment. The renter acknowledges and agrees to the following rental agreement terms and conditions:

• Deposit: To rent, SSCS requires a credit card on file for each unique rental, plus the driver’s license of the renting party. The renter’s credit card will be charged for the price of the rental at the time of booking.  If renter fails to return the equipment or returns the equipment damaged, renter agrees to charges against the renter’s credit card for the price of the equipment and/or cost to repair, replace or otherwise restore to the condition existing at the execution of this agreement.
• Responsibility for Damage or Loss: The renter agrees it is their responsibility to check the equipment at the store before setting out on any ride. The renter agrees to return the equipment in in the same clean, undamaged condition, ordinary wear and tear excepted, to avoid any additional charges for repair, maintenance or replacement. The renter agrees to properly secure/lock all equipment in legal locations when not in their possession. The renter accepts the use of the equipment, as is, in good condition and accept full responsibility for care of the equipment while under their possession. Damaged parts or components (including flat tubes and damaged tires) will be repaired/replaced at SSCS’s discretion, and the renter agrees to pay regular shop rates and retail prices for components replaced. Clean condition means normal wear and tear is excepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes. Regardless of the party at fault, the renter understands and agrees the renter will be financially and legally responsible for all damages and repairs necessary to rented equipment. In case of theft, the renter will be responsible for the cost of replacement of the equipment, including the cost of any accessories that were provided at the time of the rental. If any action is brought to enforce any of the terms of conditions of this agreement, the renter agrees to pay attorney fees, court costs, or other expenses. 
• Renter Liability: The renter will assume liability for any and all damage or loss to personal property or accident/injury to other persons related to rented equipment. 
• Late Return Fee: An additional hourly, four-hour or eight-hour rental fee, depending on actual time of return, will be charged for each hour, four hours or eight hours the renter keeps equipment after the return time/date specified. All equipment must be returned directly to SSCS’s physical location at 109 N. Station Street, Mingo, Iowa 50168, no later than the scheduled return time. 
• Weather Related Cancellation: SSCS will work with renters for rentals that are unable to occur due to weather. A minimum of a 2-hour notice is required should the renter desire cancellation due to weather. SSCS will offer a voucher for a new rental date. Said voucher will be valid for one year from original booking date. 
• No Show: No refunds will be issued for no shows. 
• Credit Card of File: SSCS reserves the right and renter fully authorizes and hereby approves to charge the renter’s credit card on file for any damages to rented items, or late return fees. 
• Acceptable Use. The renter agrees and acknowledges that he/she will be the sole operator of the equipment, and will use the equipment in a careful, safe and conscientious manner. The renter understands and agrees that any subleasing or reletting of rental equipment is prohibited and that any reletting or sublease will be a breach of this contract. The renter will at all times observe and adhere to any rules and guidelines posted by SSCS, and any applicable laws or regulations. Equipment should only be operated on legal bike paths and streets. Off-roading is prohibited while using SSCS equipment. 

·        Prohibited Activities. The renter will not violate any of the following rules and regulations during his/her operation of the bicycle:

o   There are no passengers permitted on the equipment unless expressly permitted by SSCS in writing prior to use.

o   There is no smoking while using equipment.

o   There are no alcoholic beverages permitted while using the equipment.

• Termination of Agreement: The renter agrees that SSCS has the right to terminate this agreement at any time and retake possession of rented equipment. Upon notification of termination, the renter must return the equipment to the designated return area immediately. SSCS may enter upon the premises of the renter without being liable for trespass.

I agree not to ride on trails that are closed or to trespass on posted land.

I acknowledge full responsibility for the safety of my group and agree that all members will ride safely and responsibly.

Bicycles are rented out clean and in proper working condition and must be returned in the same manner. I understand that I am responsible for returning all equipment rented and the cost of any lost or damaged equipment and labor will be charged to my credit card.  

Helmets are included in the rental, and it is strongly suggested they be worn at all times while riding equipment rented from SSCS.
