Trans Port Station LLC has agreed to rent micro transit vehicles and accessories including Ebikes and motorized scooters directly to renter as reflected in the signed sales invoice.

The document is a Contract of Rental Sale, Waiver and Release from Liability.

Renter Purchaser ____________________ agrees to all terms as follows:

        The use of the term Micro Transit Vehicle in this document is defined as Electric Bicycles, Ebikes, Electric scooters, human powered bicycles.

 When riding my rented micro transit vehicle, Ebike or escooter I agree to obey the electric bike and motorized scooter federal, California state, Los Angeles County and the cities within LA County speed limitation laws and codes as well as all other state, county, municipal and city traffic laws where I choose to ride, including all electric bicycle and motorized scooter codes and laws.  

I agree and acknowledge that anyone with serious conditions should not ride an electric bike or motorized scooter that impairs on the safe riding of the micro transit vehicle. I agree and acknowledge that no one, including myself, should ride an electric bike while under the influence of alcohol or drugs, including prescription medications, or while otherwise incapacitated. I acknowledge that riding under the influence is illegal and could bring harm to themselves or bring injury to life and limb of others.

I agree and acknowledge that it is not safe to ride micro transit vehicles  in hazardous conditions that they are not intended to be used for, including uneven or off road terrain, significant rain or in snow, and I assume all risks of riding my Ebike and motorized scooter under these and/or any other unsafe conditions.

I agree and acknowledge that riding micro transit vehicles in urban and suburban street conditions is dangerous and requires constant attention to the surroundings for potential hazards and unsafe riding conditions. It is the rider’s responsibility to follow all applicable codes and laws where they are riding.

I agree and acknowledge when riding my micro transit vehicle to respect all other rode users and act in a civil manner to pedestrians and other vehicle drivers to not create an unsafe disturbance.

 I agree and acknowledge that riding on the beach bike path can be dangerous and extra caution and care when riding on the beach bike path is required to insure the safe and continued use for all users. Special care should be taken to watch for pedestrians and other Ebike users that fail to follow rules of the rode on the bike path.

I acknowledge and understand that riding a micro transit vehicle is a dangerous activity that requires moderate exercise and various degrees of skill and experience for individual riders. I understand that biking or scootering can result in serious injury to the person or persons and damages to property.

I hereby voluntarily assume any and all risk associated with loss, damage or physical injury that occurs while riding my Ebike motorized scooter or other micro transit vehicle.

I am aware of the dangers of charging lithium batteries and the potential to cause a fire by thermal runaway. I also acknowledge and agree to charge my battery to specifications outlined by the manufacturer and Trans Port Station of the Ebike or motorized scooter. I hereby voluntarily assume any and all risk associated with loss, damage, or physical injury that occurs by charging my battery against the recommendations of the manufacturer and Trans Port Station. I agree to monitoring the charge of a battery throughout its cycle and to never leave a charging battery unattended.

I acknowledge that adding a motor to a bicycle brings an added risk. I agree to have a thorough knowledge of the dangers associated with use of a motor on a vehicle that could harm life and limb. I assume all risks from misuse or tampering with a motorized subsystem.

I am aware of the risks, hazards and dangers of personal injury, death and disability inherent in the use of motorized bicycle or scooters.

I hereby agree to release and forever discharge Trans Port Station LLC, and its agents, employees, officers, directors, component manufacturers and any and all other persons or entities acting on Trans Port Station LLC’s behalf from any and all legal claims, actions, damages, liability, costs, expenses or attorney fees related to, arising out of, or in any way connected to use of my Trans Port Station rental vehicle or use of any other equipment or property supplied by Trans Port Station or from any claim arising out of my presence upon the Trans Port Station premises and vehicles, whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of Trans Port Station, including its agents, employees, officers, directors, component manufacturers and/or any and all other persons or entities acting on Trans Port Station LLC’s behalf.

By my execution of this Contract, it is my intention to surrender and waive any and all rights to sue or to exercise a legal right to seek damages from Trans Port Station LLC, and/or its agents, employees, officers, directors, component manufacturers and any and all other persons or entities acting on Trans Port Station LLC’s behalf.

I hereby certify that I am at least 16 years of age. I acknowledge that no person under the age of 14 is permitted to ride an e-bike in the United States.  I acknowledge that there are varying state laws and regulations that apply to persons under 16 years old riding an electric bicycle and motorized scooter. In the state of California a rider needs to be at least 16 years old to ride a Class 3 electric bike that can reach 28mph or greater.  

Purchaser agrees and take on liability and supervise the safety and proper usage of Trans Port Station purchased vehicle and accessories by themselves and others then the purchaser. Consequently, Trans Port Station LLC cannot be held responsible for the safe use or other actions by the purchaser and/or future riders of the vehicles.

The renter agrees to take on liability and supervise the safety and proper usage of Trans Port Station rented  vehicle and accessories. Consequently, Trans Port Station LLC cannot be held responsible for the safe use or other actions by the purchaser and/or other riders of the rented vehicles.

              I have carefully read the foregoing and acknowledge, understand and AGREE to all of the above terms and conditions. I have had the opportunity to ask any and all questions regarding this Contract. By issuing payment for my Trans Port Station LLC purchase and executing this Contract, I assume all risks inherent in the purchase and use of an Ebike or motorized scooter, and release Trans Port Station LLC from any and all liability that may arise from my ownership and use of my Trans Port Station LLC purchase. This includes a release of Trans Port Station LLC from any and all liability related to or arising out of the illegal use of my Trans Port Station LLC purchase

Binding Arbitration Clause:  The Parties agree that any dispute, controversy or claim arising out of or relating to this Contract or as a result of the use of Trans Port Station LLC rental vehicles and accessories; including warranty claims, defective product claims, physical injury claims, property damage claims and/or whether any of the aforementioned claims are arbitrable, will be referred to and finally determined by arbitration. The tribunal will consist of a sole arbitrator. The place of arbitration shall be located in Los Angeles County, California USA. Judgment upon the award rendered by the arbitrator may be entered by any court having jurisdiction thereof. In the event a party fails to proceed with arbitration as delineated in this paragraph, unsuccessfully challenges the arbitrator’s award, or fails to comply with arbitrator’s award, the other party is entitled to costs of suit including reasonable attorneys’ fees for having to compel arbitration or defend or enforce an award.

I have read and agree to the Trans Port Station LLC terms and conditions. I agree to the terms above.

By signing below the purchaser ____________________________ has thoroughly read and understands all terms as outlined above in this contract and agrees to all terms fully.
