ADDENDUM TO YOUNG'S BICYCLE SHOP RENTAL AGREEMENT

(ASSUMPTION OF RISK AND CUSTOMERS INDEMNIFICATION FOR -E- BIKE RENTAL)

Agreement made by and between Harvey A. Young, Enterprises, Inc. d/b/a Young's Bicycle Shop (hereinafter "Young's), and

(hereinafter "Customer"). of (Name)

Customer acknowledges and understands:

1. The operation of a Class 1 e-bike equipped with a Bosch drive-unit is an activity that can involve a significant risk of personal injury, death or property damage;

2. Nantucket streets, including the downtown area, are partially paved with cobblestone, which presents a dangerous uneven terrain for e-bike riders;

3. Operation of an e-bike, in combination with the natural environmental conditions found on Nantucket, can increase the potential risk of injury;

4. The maximum speed for the operation of an e-bike on all Nantucket bike paths is fifteen (15) miles per hour;

5. E-bikes are designed for, and can only be operated by a single rider;

6. Passengers are not permitted to ride on e-bike rentals;

7. All e-bike operators must be eighteen (18) years of age or older;

8. A properly sized helmet provided and fitted by Young's without charge must be worn by e-bike riders at all times;

9. Renters of an e-bike for more than one twenty-four (24) hour period will be provided with a battery charger;

10. Charging wet or damaged batteries is strictly prohibited;

11. Customer shall be responsible for any damage to e-bike, battery and charger while in their possession, custody, and under their control.

12. Customer further agrees to assume any and all risk of injury or death which might be associated with or result from Customer's operation of an e-bike rented from Young's.

13. Customer will indemnify and hold harmless Young's, its affiliates, owners, directors, agents, servants and their assigns from any and all claims, demands, losses, or damages for personal injury or property damage caused or sustained by Customer, or to any other person or persons, as a result of Customer's operation of an e-bike rented from Young's.

Notwithstanding the foregoing, Customer acknowledges having made a voluntary and knowing decision to rent an e-bike from Young's. Customer has read and understands the terms and conditions of this Agreement, and, enters into this Agreement freely and voluntarily. This agreement shall be governed by the laws of the Commonwealth of Massachusetts.
